LICENSE AGREEMENT:
This software is licensed, not sold. Each purchase entitles the purchaser (hereinafter, LICENSEE) to use this edition of THE MESSAGE: The Bible in Contemporary Language on a single handheld or desktop computer (hereinafter, LICENSED DEVICE), in conjunction with any software capable of reading this edition. This includes explicit permission for reverse engineering under 17 USC 1201. Each purchase also entitles the LICENSEE to, at LICENSEE's sole expense, make a single backup copy on media of the LICENSEE's sole choice. LICENSEE agrees to safeguard the backup against unauthorized access to at least the level LICENSEE undertakes the safeguarding of other valuable information in which LICENSEE has a security interest, but in no case with less than a reasonable level of care.

If LICENSED DEVICE is lost, stolen, or otherwise disappears, and LICENSEE cannot recover LICENSED DEVICE, then this license shall be immediately terminated.

This license is fully transferrable from any transferor to any transferee, as long as:

  1. the transferor surrenders all rights and copies under this license to the transferee, and agrees to not to re-download or re-acquire files related to this edition without purchasing another license, and
  2. the reansferee agrees to all terms and conditions of this license.
If the license is transferred in accordance with these provisions, the transferee becomes the LICENSEE upon receipt of the software, and the transferor loses all rights under this license.

Except as mentioned above, the LICENSEE waives any rights to transfer, assign, or resell this license. LICENSEE agrees to indemnify and hold harmless NavPress, The Navigators, Yih-Chun Hu, and their assignees, agents, employees, and employers, (together, hereinafter referred to as INDEMNIFIED PARTIES) from any claim arising from the LICENSEE's use of the License. Should any suit be brought against INDEMNIFIED PARTIES, INDEMNIFIED PARTIES may, at their expense, assume control over the defense of such a suit. Alternatively, INDEMNIFIED PARTIES may, at their sole discretion, require LICENSEE to provide, at LICENSEE's expense, legal counsel and court costs for the defense of such a suit. In addition, LICENSEE agrees to not sue NavPress, The Navigators, Yih-Chun Hu, and their assignees, agents, employees, and employers, regardless of cause or legal theory, including tort and negligence. This clause shall survive the termination of this contract.

LICENSEE agrees to submit to personal jurisdiction in the State of Texas, USA, and agrees that any lawsuit arising from this license shall be brought in a court of comptenent jurisdiction in the State of Texas, and that Texas law shall in all cases apply. This clause shall survive the termination of this contract.

If any term of this license shall be deemed unenforcable, the rest of this license shall be construed to provide maximum benefit to licensors and INDEMINIFED PARTIES within the constraints of enforcability. This clause shall survive the termination of this contract.
